Thank you for considering the The Barbell Box affiliate program. Our affiliates are very important to us.  This agreement is designed
with you in mind, as well as protecting you, The Barbell Box and our customers.  Please read thoroughly.  If you have any questions, please contact us at [email protected].  Presently our program is open to affiliates whom reside in Canada, US, UK, Australia and New Zealand and all commissions are paid out in Canadian Dollars. 

Affiliate Agreement

This agreement describes the terms and conditions for participation in the The Barbell Box's affiliate program.  In this agreement, the term "Affiliate" refers to you (the applicant). In this agreement, “The Barbell Box” refers to The Barbell Box Partnership, with whom you are entering this agreement.  By signing up for the The Barbell Box Affiliate program you are confirming that you have read the agreement and agree to the terms and conditions.

Commissions

For a sale to generate a commission to an Affiliate, the customer must complete the order and remit full payment for the product. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links.  Properly coded links are the sole responsibility of the affiliate.  Commissions can be viewed on The Barbell Box Affiliate Dashboard

The Affiliate will be paid on a recurring payment schedule, they will accumulate commissions for each initial paid transaction by the customer.  For participating Affiliates, commissions will be paid once a month.

Payment

Payments will be every 30 days.  Payments will be paid out via PayPal unless otherwise agreed by The Barbell Box.

Refunds

In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.

Usage and Obligations

Affiliates are permitted to use The Barbell Box brand and marketing resources available in the Affiliates section of The Barbell Box's Affiliate Dashboard. Logos and other assets cannot be modified.  The Affiliate does not gain any trademark, copyright or any other rights to these materials.

-  The Affiliate will never imply that they are acting on behalf of The Barbell Box.

-  The Affiliate will never represent themselves, The Barbell Box or their relationship with The Barbell Box in a false or misleading way.

-  The Affiliate will not engage in the distribution of an unsolicited bulk email (spam) mentioning or referencing The Barbell Box.

- The Affiliate will not be permitted to bid against The Barbell Box using Google Ad Words.

Term and Termination

Either party has the right to terminate the agreement immediately without prior notice.

If the Affiliate terminates the agreement, no further commissions from The Barbell Box will be paid for any past or future customer transactions.

If The Barbell Box chooses to terminate the agreement, any balance greater than $100 CDN will be paid to the affiliate within 60 days of termination.  Balances that are smaller than $100 will be forfeited.

We may cancel your application if we determine that your site is unsuitable for our program, including if it:

•  Promotes sexually explicit materials
•  Promotes violence
•  Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation
•  Promotes illegal activities
•  Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other intellectual property rights or to violate the law.

It is entirely your responsibility to follow all applicable intellectual property and other laws that pertain to your site, blog, Instagram, etc.  You must have express permission to use any person's copyrighted material, whether it be a writing, an image, or any other copyright-able work.  We will not be responsible (and you will be solely responsible) if you use another person's copyrighted 
material or other intellectual property in violation of the law or any third-party rights.

Governing Law

This Agreement shall be governed and enforced in accordance with the laws of Ontario, Canada.

Arbitration

All claims and disputes arising under or relating to this agreement are to be settled by binding arbitration in the province of Ontario, Canada.

Modification

We may modify any of the terms and conditions within this agreement at any time and at our sole discretion.  These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures and Affiliate program rules.

Program termination

The Barbell Box reserves the right to modify, amend, withdraw or terminate this Affiliate program at any time and in any way, without prior notice. The Barbell Box shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with termination of the program.
